Information collected on our site is used exclusively for the purpose of preparing and completing the Canadian pardon, U.S. entry waiver, Nexus Cards and criminal record purge services requested and physical records are secured according to RCMP accreditation standards.
Waivers of Canada will never sell your personal information. Nor will we otherwise make personal information available to any third party, under any circumstance, except as is explicitly required for the completion of services you request.
Waivers of Canada will never contact or communicate with anyone other than you and the relevant third parties involved in the application requested, as required.
Documents containing personal information are mailed in unmarked envelopes to protect your identity.
Upon completion of services, Waivers of Canada retains non-payment related personal information for up to 60 days, after which time it is physically destroyed. Payment related information is kept for up to 5 years, as is legally required by the Canada Revenue Agency.
Collected Information
Information collected is necessary for the removal the individual's criminal record or for their application for advance permission to enter the USA, and may include: name, address, telephone number, date of birth, place of birth, immigration status, fingerprints, court records, local police, OPP, RCMP, and FBI records, driver's licence number, employer information, and so on.
Consent
The individual's knowledge of and consent to Waivers of Canada collection, use and disclosure of personal information is critical. Waivers of Canada relies on the following actions by the individuals as indications of their consent to our existing and future personal information practices:
- The individual's voluntary provision of personal information to us directly,
- The individual's express consent and acknowledgement contained within our written authorization agreements and application forms,
- The individual's express written consent to have her/his certified RCMP criminal record report and fingerprints forwarded to us from the RCMP,
- The individual's verbal and written consent for any further information needed to remove their criminal record or for an application for advanced permission to enter the USA.
Safeguards
- We have in place physical, electronic and procedural safeguards appropriate to the sensitivity of the information we maintain regarding individual applicants. Waivers of Canada systems forbid the transfer or disclosure of any personal information other than what is needed to accomplish the results for which the information was collected.
- Personal information held electronically is held on computers that are only connected internally. There is no hub that would allow access through the Internet.
Terms and Conditions
When you apply on this site, you agree to be bound by the
following terms and conditions:
Authorization
I authorize Waivers of Canada to act on my behalf in having my Canadian
criminal record pardoned, or my photograph and fingerprints purged, or
destroyed ,whichever is applicable, or in acquiring an U.S.A. entry waiver, or visa
waiver, if applicable. I authorize Waivers of Canada to: (i) communicate with all
government or government related organizations, including the RCMP, FBI, local
police service(s) and courts which may be of assistance in this matter; (ii) take
all reasonable steps and actions to assist me in this matter; (iii) if necessary,
transfer my file to legal counsel, at no additional cost to me, who will then have my
permission to act on my behalf.
Removal of Canadian Criminal Record:
(i) I understand that, after my file and fines have been paid in full and my statutory
eligibility date has been met, it takes about 5-12 months to complete a purge or
photograph and fingerprint destruction and about 9-18 months to complete a
pardon, and subject to change. Unpaid files and unpaid fines will slow or stop the
process. (ii) Waivers of Canada is not responsible for the removal of occurrence
or incident reports, and weapons bans, which auto-delete, free of charge, upon
eligibility; or sex offences which will appear on a police clearance specific to the
vulnerable sector. (iii) If it is necessary, I am responsible for obtaining a local police
check(s).
USA Entry Waivers:
(i) I understand that, after my file has been paid in full it takes about 6-10 months
to prepare the Waiver application and about 5-10 months to receive the Waiver
from USA Immigration, and subject to change. Unpaid files and unpaid fines will
slow or stop the process. (ii) I understand that USA Immigration requires me to
submit the Waiver Application to them and that the application will contain original
documents.
Indemnification:
You agree to defend, indemnify and hold harmless Waivers of Canada, its respective
officers, directors, employees and agents, including all third parties mentioned on
a Waivers of Canada Site, from and against any and all claims, actions or demands,
including without limitation reasonable legal and accounting fees, resulting from or
related to: (a) your breach of any of these Terms and Conditions; (b) your access to
or use of a Waivers of Canada Site, Services or Content; or (c) your use or reliance
on, or publication, communication or distribution of anything on or from a Waivers
of Canada Site or through any of the Services. You will use your best efforts to
cooperate with Waivers of Canada in the defence of any such claim. Waivers of
Canada reserves the right, at its own expense, to assume the exclusive defense and
control of any matter otherwise subject to indemnification by you.
General:
(i) Government fees and timeframes subject to change without notice. Final
decisions rest solely with government. (ii) Urgent files are handled differently
in the Waivers of Canada office. Waivers of Canada has no control over statutory
eligibility dates, or Canadian and American Governments. (iii) It is my
responsibility to (a) contact Waivers of Canada if I move or change my telephone
number(s); (b) comply with requests by Waivers of Canada for documents. Pursuant
to our Privacy Policy and Privacy Legislation, failure to do so may result in your
file being destroyed, and you will have to start the process again. (iv) Once the
process has been completed, all of Waivers of Canada's computer files pertaining
to my file shall be destroyed. (v) Once the process has been completed, all hard
copy information concerning my application(s) shall be returned to me, or shall
be destroyed, whichever I decide. (vi) I understand that failure to complete the
sentence ordered by the judge or further personal criminal activity, occurring while
my application(s) is/are in process, may result in a significant postponement on
my eligibility, and I further understand that any delay caused by my own activity
will result in further charges to be covered by me. (vii) Cancellation requests made
in writing within 10 business days will be refunded minus a $350 administration,
set up fee, as well the lawyer review fee before the application is processed. All
cancellation requests made after 10 business days will not be refunded. (viii) As
my file proceeds, I authorize any balance owing to be charged to the credit card
on file. Monies paid to Waivers of Canada are used to pay for disbursements, and
towards gathering information and documentation, communicating with various
government organizations, preparing and completing the required documents and
supporting materials, submitting requests and other documents to the appropriate
organizations, completing applications for submission. Final decisions rest solely
with government.

General Provisions:
These Terms and Conditions you have entered into are personal to you, and you
may not assign your rights or obligations to anyone. These Terms and Conditions
constitute the entire agreement between Waivers of Canada and you pertaining
to your use of the Waivers of Canada Site, Services and Content and supercede
any prior agreements between you and Waivers of Canada with respect to the
subject matter hereof. Waivers of Canada's failure to insist upon or enforce
strict performance of any right or provision of these Terms and Conditions will
not constitute or be construed as a waiver of any right or provision. If any of
the provisions (or parts thereof) contained in these Terms and Conditions are
determined to be void, invalid or otherwise unenforceable by a court of competent
jurisdiction, such determination will not affect the remaining provisions (or
parts thereof) contained herein. Except where prohibited by applicable law, any
cause of action you may have with respect to your use of the Waivers of Canada
Sites or which is the subject of these Terms and Conditions must be commenced
within one (1) year after the claim or cause of action arises. No changes to your
service agreement or these Terms and Conditions will be made except as expressly
contemplated herein.
Limitation of Liability:
You expressly understand and agree that in no event will Waivers of Canada be
liable for any damages whatsoever, including any direct, indirect, incidental,
consequential, special or exemplary damages, and any damages for loss of profits,
savings, goodwill or other intangible losses, regardless of whether Waivers of
Canada had been advised of or could have foreseen the possibility of such damages,
arising out of or in connection with: (a) the use, inability to use or performance of
any of the services of the Waivers of Canada site, or (b) any unauthorized access to
or modification to any information or transmissions, or (c) any other matter relating
to the Waivers of Canada site or any of the services.
Termination:
Waivers of Canada reserves the right to suspend or terminate your file and your
access to the Site, Services and Content, at any time for convenience, or for any
other reason, including without limitation, if: (a) the File Credit Card is invalid
for any reason; (b) you give Waivers of Canada false or misleading information;
(c) Waivers of Canada does not receive any payment when due; or (d) Waivers
of Canada has determined, in its sole discretion, that your use of the Waivers of
Canada Site or any of its Services was in breach of these Terms and Conditions or
you are using the Services for unlawful or improper use. Any such termination
by Waivers of Canada will be in addition to and without prejudice to such rights
and remedies as may be available to Waivers of Canada, including injunction and
other equitable remedies. Your ability to use Waivers of Canada as an agent is also
subject to any limits established by Waivers of Canada or by your Account Credit
Card issuer. If Fees cannot be charged to your Account Credit Card or your charge
is returned for any reason, including chargeback, Waivers of Canada reserves the
right to either suspend or terminate your file. The disclaimer, limitations on liability,
and indemnity provisions herein will survive termination or expiry of your file, and
these Terms and Conditions.
